By accessing or using SimpleClaw ("the Service"), operated by SimpleClaw ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

SimpleClaw is a platform that allows users to deploy and manage OpenClaw AI assistant instances on messaging platforms such as Telegram, Discord, and WhatsApp. The Service provides one-click deployment, AI model selection, and instance management capabilities.

3. Eligibility

You must be at least 18 years of age to use the Service. By using SimpleClaw, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these terms.

4. Account Registration

To use the Service, you must create an account using Google authentication. You are responsible for maintaining the security of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

5. Subscriptions and Payments

• All payments are processed securely through our payment provider.
• Subscription fees are billed on a recurring monthly basis and renew automatically unless cancelled.
• Additional credits can be purchased as one-time top-ups.
• Prices are displayed in USD and may be subject to applicable taxes.
• You are responsible for providing accurate and up-to-date payment information.

6. Refund Policy

All payments are final and non-refundable. By subscribing to or purchasing credits through the Service, you acknowledge that you will not be entitled to a refund for any reason, including but not limited to dissatisfaction with the Service, unused subscription time, or unused credits.

7. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited messages, or bulk automated communications.
• Distribute malware, viruses, or other harmful software.
• Engage in any illegal activities or violate any applicable laws.
• Harass, abuse, threaten, or intimidate other users or third parties.
• Attempt to gain unauthorized access to the Service or its related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Impersonate any person or entity, or misrepresent your affiliation.
• Use the Service in any way that violates the terms of the underlying AI model providers.

8. Third-Party AI Models

The Service integrates with third-party AI model providers including Anthropic (Claude), OpenAI (GPT), and Google (Gemini). Your use of these models through SimpleClaw is also subject to the respective terms and acceptable use policies of these providers. We are not responsible for the outputs generated by these AI models.

9. Intellectual Property and Confidentiality

The Service, including its design, code, architecture, and branding, is the property of SimpleClaw and is protected by applicable intellectual property laws. You retain ownership of any content you create or configure through the Service, including bot configurations and conversation data.

You agree not to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, underlying infrastructure, technologies, or architecture of the Service. You shall not disclose, publish, or share any information about the Service's internal systems, third-party providers, technical stack, or implementation details obtained through your use of the Service.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

11. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime in advance.

12. Limitation of Liability

To the maximum extent permitted by law, SimpleClaw shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You agree to indemnify, defend, and hold harmless SimpleClaw and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Service or your violation of these Terms.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to a violation of these Terms. Upon termination, your right to use the Service will immediately cease.
